At least 50 immigrant children under age 5 will be released with their parents by Tuesday's court-ordered deadline for the Trump administration to reunify families forcibly separated at the border, a government attorney said today.

"I am very encouraged about the progress", Sabraw said during a hearing in U.S. District Court in San Diego. But only 56 out of about 85 children under five who are eligible for reunification will have been reunited with their parents by the Tuesday deadline.

But The New York Times reported late last week that, under pressure to reunite the families, authorities were struggling to connect them after records linking children to their parents disappeared and in some cases were destroyed, although not as part of a deliberate attempt to obfuscate. The ACLU would like a faster reunification process while the USA government claims they are bound by strict protocols, such as a plan to DNA test every child and parent before a reunification can occur.

And why did the government say they can't meet the deadline? "And that child may be separated from you, as required by law".

Children were increasingly separated from their parents after Attorney General Jeff Sessions announced in May that a zero-tolerance policy on illegally entering the country was in full effect.

The judge ordered the attorneys to file more thoughts by Monday evening on the timelines and procedures for reuniting those parents who will not rejoin their children Tuesday, and the court will hold another hearing Tuesday morning to discuss the issue further.

"ICE will take custody and then release the parent and child together", Fabian said at Monday's hearing.

The plan for Tuesday was unusual not only for its secrecy, but for its oversight: The Department of Homeland Security is not typically involved directly in family reunifications.


Federal officials have said somewhere "under 3,000" migrant children have been separated overall, but their numbers have varied.

Additionally, Gelernt took issue with the Trump administration's claim that it has lost track both of parents who have been released by ICE within the US pending their immigration or asylum hearings and at least nine parents who it deported without their children.

Sabraw declined on Friday to grant the government an extension but indicated he might be willing to do so if officials provided the court and the ACLU with a detailed list of the children and status of their reunification.

We are going to propose within 48 hours of contacting a parent who is in the USA, and within one week of contacting a parent who's already been removed to another country.

Because ICE has not yet built detention centers suitable to hold young children, Fabian told the court on Monday, the reunited families will be set free on supervised released while they pursue their asylum claims.

"The kids are all over the country", said ACLU lawyer Lee Gelernt.

One child has not been matched with a parent, Fabian said. He added that nonprofit groups were trying to find parents the government had failed to locate, who are mostly from El Salvador, Guatemala and Honduras. Unaccompanied children, some as young as 1 year old, have been kept in large chain link cages, and in some cases, forced to represent themselves in court.

And if they continue to drag on, what would you ask the judge to do in that instance? The judge didn't buy this argument, and the ACLU denounced the Trump administration's efforts to push back the deadline as a shameful attempt to "further prolong the suffering of these families".
