Trump's lawyer Michael Cohen expected at court hearing, Stormy Daniels to attend

Trump's lawyer Michael Cohen expected at court hearing, Stormy Daniels to attend

On Sunday night, an attorney for Mr Trump filed papers seeking to bar the US Department of Justice from reviewing the documents seized from Mr Cohen.

Last week's raids came after a "months-long" investigation related largely to Cohen's business dealings, rather than his work as a lawyer, prosecutors have said.

"Attorney Client privilege is now a thing of the past", Trump wrote.

Todd Harrison, a lawyer for Cohen, said at Friday's hearing that "thousands" of documents seized were likely privileged, and that many related to clients other than Trump. During that session, lawyers for Cohen are expected to tell the judge overseeing the case how many legal clients he has and how many seized documents he thinks might be covered by attorney-client privilege.

It's not often that the leader of any country gives a public opinion about lawyer-client confidentiality or privilege. The FBI reportedly raided his office and residence a week ago looking for information pertaining to the Daniels payment and the one given to a former Playboy Playmate, Karen McDougal, who claims she had a monthslong affair with Trump between 2006 and 2007. And Mr. Trump has implied that he has this privilege with Cohen, evident in his tweet after the raid of Cohen's office.

Assistant U.S. Attorney Thomas McKay said in court that the government took images of the contents of most electronic devices, leaving them behind after the raids, and that cataloguing evidence might be delayed because some devices must be sent to an Federal Bureau of Investigation laboratory to "decrypt" because they require code words.

Michael Cohen, President Donald Trump's longtime personal attorney, on Saturday shot down a McClatchy report alleging that Special Counsel Robert Mueller has evidence Cohen went to Prague during the 2016 election.

Cohen was the target of an Federal Bureau of Investigation raid last week, and the person who paid Daniels $130,000 on the eve of the 2016 presidential election. While Cohen is not in the same situation, there are certainly extraordinary circumstances, given that one of his clients in the President of the United States, and there may be documents involving Trump that have nothing to do with criminal activity.

"Under the President's theory, every person who has communicated with a lawyer would be given the power to turn every search warrant into a subpoena and to demand the return of lawfully-seized evidence in order to undertake their own review of the evidence".

"The President objects to the government's proposal to use a "taint team" of prosecutors from the very Office that is investigating this matter to conduct the initial privilege review of documents seized from the President's personal attorney, Michael D. Cohen", Hendon writes. Before that, he tweeted that "attorney-client privilege is dead" and lashed out at the investigation, calling it a "witch hunt".

The answer, the attorneys say, is Trump, the privilege-holder, "should be permitted to review the materials for privilege in the first instance".

The revelation comes amid a courtroom drama that unfolded Friday, as Cohen's attorneys and Trump's attorneys began a fight hours before with the US Attorney's Office in Manhattan over a massive raid of Cohen's records. All lawyers are deflated and concerned!'
