Court orders National Assembly to halt electoral amendments

"As a responsible Parliament, we've agreed with two of the three reasons given by the president".

"We will re-gazette the electoral act and expunge the areas which the president mentioned and which we are in agreement with the president and in line with the constitution".

"The amendment to Section 152 Subsection 325 of the Principal Act may raise Constitutional issues over the competence of the National Assembly to legislate over local government elections", he stated. We know that we don't have the power to act on that.

They expressed grievances over President Buhari's action which rejects the Electoral Amendment Act that seeks to re-order the sequence of 2019 elections.

The 10 bills are the Peace Corps Bill; Bill for Chartered Institute of Treasury Management Bill; Nigeria Council for Social Works Bill; Currency Conversion Bill; Police Procurement Fund Bill; Environmental Health Officers Registration Bill and Chartered Institute of Loan and Risk Management in Nigeria.

A bill for an act to establish the Chartered Institute of Exports and Community Brokers of Nigeria and a bill for an act to establish the Federal University, Wukari were also listed.


The Federal High Court, Abuja, on Wednesday, asked the National Assembly not to take any action on the Bill amending the Electoral Act which President Muhammadu Buhari refused to sign into law.

The restraining order issued by Justice Ahmed Mohammed is to last till March 17, which is the next hearing date.

The presiding judge invoked section 6 (6) of the 1999 constitution, as amended, which according to him, empowered the court to protect the Res (subject matter) of the substantive suit pending before it.

Mohammed directed that the hearing notice be served on the 2nd defendant in the case, Attorney General Abubakar Malami; and then adjourned the case till Tuesday, March 20.

Chinelo Ogbozor, counsel to the national assembly, had opposed the Olanipekun's appeal but to no avail.

His decision to withhold his assent to the bill saw some legislators vowing that the National Assembly was going to evoke its powers under Section 58 (5) of the constitution to override the President's withholding of assent by two-thirds majority votes of both chambers.
