Kenya revokes deportation of lawyer who 'swore in' opposition leader

A Kenyan court on Thursday revoked the deportation of a lawyer who "swore in" opposition leader Raila Odinga as the country's "president", a ruling likely to worsen relations between the judiciary and President Uhuru Kenyatta's government.

Justice Luka Kimaru said the order by Interior Cabinet Secretary Fred Matiangi was illegal, hence making the deportation null and void.

Further, Dr Matiang'i argues that the issue of deportation of Dr Miguna is pending before another High Court judge and can not be adjudicated upon without a valid hearing.

The development coming hours after Justice Luka Kimaru declared the decision by the government to deport the self proclaimed National Resistance Movement general to Canada illegal.

He directed immigration director Gordon Kihalagwa to surrender Miguna's passports to court within seven days.

Last week, the vocal lawyer was controversially deported to Canada after being held for five days.

In a statement sent to newsrooms, Principal Secretary Ministry of Interior Karanja Kibicho faulted the ruling saying that the deportation was conducted within the confines of the law.

Meanwhile the oppositional National Super Alliance coalition's commitment to running a parallel government is steadfast as they promised to launch a National People's Constituent Assembly within 10 days.

Miguna said in a tweet after the ruling that: "We shall use the CONSTITUTION as the SPEAR and the SHIELD in the fight against the despots".

"It is quite unfortunate because the government has the highest responsibility through the president of the Republic of Kenya who has sworn to uphold the rule of law, so the government must respect court orders and must uphold the rule of law and must obey the law", Wambua said.
