Judge Loya death: Opposition takes issue to President, seeks SIT probe

In New Delhi In a concerted move to secure justice for Special CBI judge BH Loya, a united Opposition led by Congress chief Rahul Gandhi on Friday met with President Ram Nath Kovind and submitted a memorandum seeking an independent probe into his death. "What is required is a thorough investigation through a team of independent officers selected and monitored by the Supreme Court", the memorandum stated. "We don't trust the CBI or NIA (National Investigation Agency) because we know what CBI and NIA officials do", Sibal said, referring to the 2G spectrum allocation case in which a special court let off all accused including former communications minister A Raja. It was signed by 114 MPs from 15 parties, including the TMC, SP, NCP, DMK, RJD and AAP as well as the Left parties.

Advocate P.S. Surendranath, appearing for the All India Lawyers' Union, sought an independent probe into the death of judge Loya and urged the court to ensure that judges dealing with high-profile cases, particularly those belonging to politicians, should be provided "Z-plus" category security.

On December 1, 2014, Judge Loya, who was hearing the sensitive Sohrabuddin Shaikh fake encounter case, died of cardiac arrest, when he had gone to attend the wedding of a colleague's daughter. "It will be an ode to him and his family that the investigation takes place properly", Rahul told reporters after meeting the President and described his response as "positive".


The memorandum also mentioned that two confidants of Loya - lawyer Shrikant Khandalkar and retired district judge Prakash Thombre - also died under suspicious circumstances. "These matters can not be decided through a Public Interest Litigation", he said.

The matter came under the spotlight after a magazine quoted Judge Loya's younger sister's fueled suspicion about the circumstances surrounding his death. Criminal Procedure Code 174 was violated in the way Loya's death was handled, Jaising said. "The diary would also provide a minute-by-minute account of the happenings", she said, urging the court to summon the case diary from the government for scrutiny by the bench.

"To uphold the majesty of law, we request you to intervene in the matter".
