In November 2016, the NCAA ruled that Notre Dame had to vacate all of its victories (21) from the 2012 and 2013 seasons, as a result of a student athletic trainer committing academic misconduct for two former football players and providing six other former football players with impermissible extra benefits.

The NCAA rejected Notre Dame's appeal of 21 vacated wins, making the Fighting Irish's all-time win total 885.

Jenkins didn't name the North Carolina case but referred to a "recent high profile academic misconduct case in which the NCAA Committee on Infractions chair explained that even though certain classes "more likely than not" were used to keep athletes eligible with fraudulent credits, the legitimacy of those classes was beyond the jurisdiction of the NCAA's enforcement process precisely because that question must be left to the determination of the university in the exercise of its academic autonomy".

He argued that if Notre Dame had simply expelled the players, or not penalized them at all, they would not have been ineligible and the NCAA would have had no standing to take away the wins.


The Irish won 12 games in 2012 before losing to Alabama in the BCS championship game and went 9-4 in 2013. Three of them were deemed ineligible retroactively. While an investigation found that the Chapel Hill campus had offered made-up courses for the goal of forwarding athletes academically, the NCAA ruled that it couldn't conclude UNC was in violation of any existing rules.

Notre Dame says it self-reported each of the infractions.

Along with the lost wins, the Division I Committee on Infractions panel previously announced punishments that included a year of probation and a $5,000 fine for the university based on findings the trainer completed course work for two student-athletes, while a third committed separate individual misconduct. Following the NCAA's denial of Notre Dame's appeal, school president John Jenkins penned a letter saying that the university is "deeply disappointed" and "strongly disagrees" with the ruling.

"It was student-on-student cheating", he told reporters. In every other case in the record-meticulously detailed in the University's arguments-the institutional representative of the university was employed as an administrator, coach, or person who served in an academic role. The appeals committee confirmed that at the time of the violations, the athletic training student was considered a university employee under NCAA rules. Today, the NCAA appeals committee denied the appeal.
