Government, citing ruling, again will accept requests for DACA protection

In a statement issued Saturday, U.S. Citizenship and Immigration Services said those previously granted deferred action under DACA may request renewal by filing the proper forms. The program will be operated under the same terms as before the Trump administration rescinded the program on September 5, the agency said.

Alsup said that reasoning was flawed because the agency and administration do have the authority to implement the program, which allows children brought to the country as undocumented immigrants stay and work legally for two-year intervals.

It was unclear at the time, The Washington Post reported, when DACA recipients could begin applying for renewal of their work permits as a result of the court order.

A bipartisan group of Republican and Democratic senators working to find a compromise to coincide with a looming spending bill vote on January 19, announced Thursday they had reached a tentative agreement on an immigration bill that addresses several issues, including border security and allowing young undocumented immigrants brought to the U.S.as children, known as "Dreamers", to permanently legalize their status.


In deciding to end Deferred Action for Childhood Arrivals, the Trump administration had called it an egregious example of executive overreach.

A judge said maybe racism was behind President Donald Trump's decision to shut down a program protecting young undocumented immigrants from deportation.

Trump said in September that he was ending the Obama-era program. That suit challenges the decision to end the program. No new applications will be accepted.

The USCIS announcement comes on the heels of U.S. District Judge William Alsup's issuance on Tuesday of a nationwide injunction blocking the Trump administration's effort to rescind the program.
