'Arrogant' surgeon burned his initials onto patients' livers during transplants

"Arrogant" surgeon avoids jail after branding transplant patients with initials during surgery A surgeon who burnt his initials into a patient's newly transplanted liver has avoided jail despite the freaky "abuse of power" at a United Kingdom hospital.

Speaking after the hearing, Frank Ferguson, head of special crime at the Crown Prosecution Service, refused to be drawn on whether Bramhall had carried out the practice on other patients but said he did not anticipate any further charges.

" 'Bramhall used an argon beam coagulator, which seals bleeding blood vessels with an electric beam, to mark his initials on the organs, ' the AP writes".

Bramhall resigned from the Birmingham hospital in 2014 after another surgeon found "SB" branded into a liver and raised concerns.

In a victim impact statement, she said the moment she was shown the mark "will forever be etched on my mind".

After Bramhall's pleas were entered, prosecutor Tony Badenoch QC described the case as "without legal precedent in criminal law" and said the offences were committed in the presence of medical colleagues.

"What you did was an abuse of power and a betrayal of trust that these patients had invested in you".

Bramhall later told police officers that "in hindsight" he had been naive and foolhardy during a "misjudged attempt to relieve the tension in theatre".

"It was what I would imagine the feeling is for someone who is a victim of rape".

Patient A's donor organ failed a week after the operation - for reasons unconnected to its implantation - and another surgeon spotted Bramhall's initials "SB" branded on the organ.

The University Hospitals Birmingham NHS Foundation Trust said: "The Trust is clear that Mr Bramhall made a mistake in the context of a complex clinical situation and this has been dealt with via the appropriate authorities, including the Trust as his then employer".

Bramhall was sentenced to a 12-month community order, as well as 120 hours of unpaid work, along with the fine on Friday, the Telegraph reports.

"I accept that you didn't intend or foresee anything but the most trivial of harm would be caused".

One of the patients supporting the surgeon was Barbara Moss, who was given just three months to live in 2006 when Simon Bramhall told her he would operate on a 15cm tumour.

The consultant was given a formal warning by the General Medical Council professional body last February.

Defence barrister Michael Duck QC said: "A number of people who sit in this court are able to sit in this court because of the skill of Mr Bramhall".
