Lawsuit: Two women accuse Uber of misrepresenting the safety of its platform

Uber is facing group litigation over its safety practices after complaints of sexual assault committed by drivers.

Uber has yet another lawsuit on its hands.

The lawsuit alleges that Uber markets to young women traveling alone and puts profits over their safety.

The complaint, filed in a USA district court in San Francisco, California, today seeks damages, stricter screening for drivers, insurance coverage for riders, and disclosure of the number of reports Uber has received about rapes, sexual assaults and gender-related harassment.

Uber Technologies Inc. on Tuesday was hit with a class action lawsuit brought on behalf of women who have been sexually assaulted or raped by drivers for the ride-hailing giant.

"On notice of the magnitude of the number of passengers who have experienced sexual harassment and gender-based violence, Uber should have made drastic changes to the way that it screens and monitors drivers", says the complaint, which was filed in the U.S. District Court for the Northern District of California. The suit claims that this isn't a case of "rogue" drivers, but that Uber has created a system that allows for "bad actors to gain access to vulnerable victims". Nothing meaningful has been done to make rides safer for passengers - especially women.


Uber says it's reviewing the complaint and that the allegations are important and will be taken seriously.

Earlier this year, a woman raped by an Uber driver in India sued the company.

The lawsuit was filed on behalf of all USA riders who were "subject to rape, sexual assault, or gender-motivated violence or harassment by their Uber driver in the last four years".

The suit was filed by Wigdor LLP, a NY law firm that has previously represented women who were allegedly victims of sexual violence at the hands of Uber drivers. The complaint cites accounts of assault by Uber drivers shared as part of the #MeToo movement; failures of background checks, including the registration as an Uber driver of the truck driver in the terrorist attack in NY on October 31; the debate over whether Uber drivers are employees of Uber; and misleading advertising from Uber about "safe rides". It is time for Uber to "Do the right thing". It's unclear whether Uber received complaints specific to these drivers.

And it recounts a handful of sexual assaults involving Uber drivers among several hundred that have been described in news reports in recent years.
