Should Sabarimala Shrine Allow Young Women? India's Top Judges To Decide

A three-judge Bench of the Supreme Court today referred the case relating to entry of women in Sabarimala temple to a Constitution Bench.

In February, the apex court had reserved its order on referring the case to a constitution bench. The management of the Sabarimala temple has said earlier the ban on women entry between the ages 10-50 was because they can not maintain the purity on account of menstruation.

The UDF government had taken a view that it was against the entry of women of the age group of 10-to-50 years as such a practice was being followed since time immemorial.

In January 2016, the Supreme Court had challenged the ban saying that restriction on women from entering the temple can not be done under the Constitution and in February 2017, it reserved its order.

"Such practices that exclude women from practising their freedom of religion need to be tested against the fundamental rights of the country", Chief Justice of India Dipak Misra while announcing the observation commented.


The temple prohibits entry of women who are in their menstruating years.

The court is hearing a plea challenging the practice of banning entry of such women in the temple.

The petition assailing the above Rule and seeking lifting of ban on entry of women was filed by Indian Young Lawyers Association more than a decade ago - in 2006. The Kerala High Court had upheld the custom in 1991.

The management of the Sabarimala temple had told the apex court that it had banned the entry of women because they can't maintain their "pureness" on account of menstruation. I am hoping that tomorrow entry of women in Sabarimala would be positive. Meanwhile, the apex court had asked all the parties to submit their submissions. It said that this can not be done under the Constitution.

Commenting on matter, an activist said that since last couple of months, we have seen that the Supreme Court is bringing out several progressive and landmark judgments; we are hoping that ruling on entry of women in Sabarimala would be positive. It violates the rights of women.
