Ezekiel Elliott suspension restored by federal appeals court

On Thursday, a federal appeals court overturned the district court's decision in the Ezekiel Elliott case.

The NFL filed in the NY court because it is the home of league headquarters and was the site of Elliott's appeal hearing with Henderson.

The vacated ruling means Elliott's suspension could start after the bye, though Elliott's team and the NFLPA will file for an injunction in the Southern District of NY in hopes the running back can keep playing.

Last month, the National Football League requested an emergency stay of a judge's injunction that allowed Elliott to play indefinitely, saying the court didn't have subject matter jurisdiction to make the decision.

The latest motion in Ezekiel Elliott and the NFL Players Association's legal battle with the NFL has been decided.

Elliott, the league's leading rusher last season as a rookie, has totaled 393 rushing yards in five games this season. That suspension would last through the Cowboys' Thanksgiving matchup with the Chargers. He would then return to face the Redskins on November 30.


"So the Players Association could ask the district court in NY or perhaps some other court to reinstate the preliminary injunction, which would put that suspension back on hold", Feldman said on NFL Network's TNF First Look.

The NFL announced the suspension August 11 after its year-long investigation found that Elliott caused physical injury to a former girlfriend in three instances.

Elliott, 22, has repeatedly denied any wrongdoing. Similar circumstances could follow here, with Elliott serving the suspension next year, or the court could lean on the Brady precedent and require Elliott to begin serving his suspension against San Francisco this month.

The Manhattan court will be charged with making the same decision already made by Mazzant - whether the league's disciplinary process was "fundamentally unfair" to Elliott. In that scenario, it vacates the decision of the Sherman court, throws it out. Elliott will have to get another injunction in NY in order to keep playing this season.
